Massive Regulatory Barriers to Overcome: Foreign Exchange Transactions Act and Virtual Asset Act

Even if the technical preparations are complete, reaching commercialization requires overcoming Korea's dense regulatory barriers. Currently, South Korean financial authorities maintain a very conservative stance on the issuance and transfer of stablecoins using public blockchains.

The first legal hurdle is the Foreign Exchange Transactions Act. Under current law, overseas remittances and foreign currency settlements can only be handled by authorized financial institutions or registered small-sum overseas remittance businesses. However, if remittances occur via the Solana network—an open network—it becomes difficult to clearly define the entity responsible for the flow of funds, and there is room for interpretation that opaque intermediary paths were involved. The key issue is whether authorities will approve transactions on a public blockchain as a legal means of foreign currency remittance.

Consistency with the Virtual Asset User Protection Act is also a difficult challenge. This law mandates the segregated custody of user assets and strict Anti-Money Laundering (AML) and Know Your Customer (KYC) obligations. Implementing and proving to authorities that the system has traditional financial-level control and real-time transaction monitoring in a public blockchain ecosystem where anyone can access it requires a very high level of technical and institutional sophistication.

Ultimately, for this partnership to move beyond a one-time technical test (PoC) and settle as a practical service, entering a regulatory sandbox or coordinating closely with authorities on guidelines must come first. Without institutional consensus, it will be difficult for Toss Bank's 15 million users to experience Solana-based innovative remittance services directly for the time being.
