A significant move that could alter the landscape of U.S. cryptocurrency regulation in the second half of the year has been detected. It has been confirmed that the draft of the 'Regulation Crypto' proposal, which the SEC is pushing, is currently under review by the White House Office of Management and Budget. With the likelihood of the anticipated Clarity Act passing in Congress recently falling to around 28% and hitting a deadlock, authorities appear to be accelerating efforts to forge a path forward through executive action.
This regulatory proposal is a key outcome of 'Project Crypto,' a joint collaboration between the SEC and the CFTC. It includes a three-stage safe harbor guideline, such as a $5 million exemption clause for startups and an annual funding exemption limit of $75 million. The goal is to encourage regulatory compliance while providing some breathing room for the market. It appears that with legislation stalled, the agency is looking to set the framework through administrative guidelines first.
Of course, it's too early to be entirely optimistic. Unlike congressional legislation, executive-led rule-making has the weakness of being potentially overturned depending on the administration's stance. It is also expected to take several more quarters before any tangible benefits reach the market. However, it is worth watching the review process closely, as it signals a shift away from the enforcement-heavy regulatory approach that has long stifled the industry toward establishing clear standards.
